Terms of Use

1. Scope

These Terms of Use (the "Terms") govern the use of services provided by ULT COLONY Inc. under the brand "HAKUBA Heli Backcountry Adventures" (the "Services"). By using the Services, customers ("Customers") are deemed to have agreed to these Terms.

2. Definitions

• "Company": ULT COLONY Inc. (HAKUBA Heli Backcountry Adventures)
• "Site": the website operated by us (https://www.hakubaheli.jp/)
• "Partners": air operators, pilots, guide companies, insurers, payment providers and other parties cooperating with us
• "Reservation": a booking accepted by us with payment confirmation or authorization

3. Agreement and Changes

We may revise these Terms as necessary. The revised Terms take effect when posted on the Site. Material changes will be announced appropriately.

4. Formation of Reservation

A reservation is formed when we confirm acceptance and confirm payment/authorization by the specified due date. We may not accept reservations due to full capacity or other reasons.

5. Fees and Payment

Fees, payment methods and timing are as indicated on the Service pages or as otherwise notified by us. Japanese Yen is the default currency.

6. Cancellation / Changes / Refunds

Customer-initiated cancellations/changes/refunds are governed by our Cancellation Policy. Weather/safety-related cancellations are also handled per the policy.

7. Service Conditions and Suspension

• Safety is our top priority. We or Partners may suspend/modify operations due to weather, equipment issues, flight operations or other unavoidable reasons.
• Rescue missions and public-interest flights may take precedence.

8. Assumption of Risks and Safety Compliance

• Helicopter boarding and mountain activities involve inherent risks (falls, hypothermia, rockfall, avalanches, equipment failure, etc.). Customers participate at their own risk.
• Follow instructions of our staff, pilots and guides; wear safety gear and comply with restricted areas. Non-compliance may lead to discontinuation of participation.

9. Participation Requirements

• Age/health/equipment conditions are specified on each Service page. Minors require parental consent.
• We may refuse participation if a customer is unfit (e.g., illness, pregnancy, intoxication, drugs) at our reasonable discretion.
• Insurance and specific gear may be required.

10. Prohibited Acts

• Unlawful/immoral acts, infringement of third-party rights, dangerous behavior
• Disobeying safety management or staff instructions
• False declarations, resale/transfer, damage to equipment
• Harassment of other participants, neighbors or wildlife

11. Intellectual Property

Content on the Site is owned by us or right holders. Unauthorized use is prohibited.

12. Privacy

Personal data is handled per our Privacy Policy, including necessary sharing with Partners (air operators, guides, insurers, etc.).

13. Anti-Social Forces

We refuse use by anti-social forces. Contracts may be terminated if applicable.

14. Disclaimer

We are not liable for damages arising from force majeure or causes beyond our reasonable control (natural disasters, weather, epidemics, accidents, transport/communication failures, partner circumstances, etc.).

15. Limitation of Liability

Except for willful misconduct or gross negligence, our liability shall be limited to the amount actually paid by the customer most recently. Indirect/special/consequential damages and lost profits are excluded except for willful or gross negligence.

16. No Assignment

Customers may not assign or transfer their contractual position or rights/obligations without our prior written consent.

17. Severability

If any provision is held invalid or unenforceable, the remaining provisions remain in full force.

18. Governing Law and Jurisdiction

Governing law: Japan. Exclusive jurisdiction: courts having jurisdiction over our head office in Nagano, Japan.
